LA Rapper Shot and Killed By Police
Last Wednesday, near the intersection of Valerio and
Kester in Van Nuys, a L. A. P. D. motorcycle officer, shot and killed a 25
year old man named Byron San Jose. Byron was an MC and all he was armed
with, if anything, was a tripod microphone stand. Nonetheless, the
L. A. P. D. officer shot him in cold blood.
The family and family
supporters will be protesting tomorrow morning, Tuesday, March 4, at
10:00am at the police station located at 150 N. Los Angeles Ave. Please
support and attend if you can; repost and spread the word. How much
longer will the L. A. P. D. be allowed to get away with these sorts of
things??
Here is the one-sided story of what happened from the L. A. P. D. site itself:

Los Angeles: Officer assigned to the Valley Bureau Violent Crime Task Force was involved in an officer involved shooting.
On February 27, 2008, motorcycle officer Derek Mousseau, a 12-year veteran of the Department and his partner, were assigned to the Valley Bureau Violent Crime Task Force.
At around 6:50 p.m., the officers saw Julio Eddy Perez commit a traffic violation while driving a 1997 burgundy Saturn in the vicinity of Van Nuys Boulevard and Valerio Street. The officers conducted a traffic stop at Cedros and Valerio Streets when they saw four other males in the car. After a brief conversation with the officers, Perez drove away and a short pursuit took place.
At the corner of Valerio and Kester, the left rear passenger, Byron San Jose got out of the car, holding a black metal object with both hands. San Jose advanced on Officer Mousseau's partner who was still seated on his motorcycle causing him to accelerate and strike San Jose with the front of his motorcycle. At the same time, Officer Mousseau dropped his motorcycle in the roadway and deployed his service pistol, resulting in an officer involved shooting. During the confrontation with San Jose, suspect Perez drove away. The car was abandoned in the vicinity of Willis and Saticoy and the occupants left on foot. Four of the five occupants are accounted for including the driver, suspect Perez.
San Jose received multiple gunshot wounds and was pronounced dead at the scene by Los Angeles City Fire Department personnel.
No officers were injured. The black metallic object possessed by San Jose, turned out to be a metal microphone stand approximately three feet long with a tripod base.
Force Investigation Division personnel responded to the scene and investigated the use of force and the officer involved shooting.

LAPD offers few details in fatal shooting

VAN NUYS - A day after an LAPD officer shot and killed a Van Nuys man, police provided few details about the Wednesday shooting, while a brother of the man killed disputes reports that he might have waved a tripod in a threatening way.
The shooting occurred when two motorcycle officers with the department's violent crime task force, assigned to Van Nuys to help curb crime, attempted to pull a 1997 Saturn over near Cedros Avenue and Valerio Street around 6:55 p.m. when the driver took off, police said.
After a short pursuit, passenger Byron San Jose, 25, jumped out of the Saturn near Valerio Avenue and Kester Street and began to swing an object, believed to be a tripod, when one of the officers shot him, said Sgt. Zultan Mako of the Los Angeles Police Department's Van Nuys Station.
In June, San Jose was convicted of carrying a loaded firearm and received a sentence of 72 days in state prison and two years probation, according to court records.
Following the shooting Wednesday, the driver of the Saturn drove off with four male passengers, said Deputy Chief Michel Moore, commanding officer for the LAPD's Valley Bureau.
The car, which police said Thursday was not stolen, was abandoned a couple of blocks away. Police set up a perimeter and eventually took into custody at least three of the car's occupants, described as Latino males in their teens and 20s.
Since the investigation is ongoing and little information has been released, it's unclear whether any of those individuals were still in custody Thursday, said April Harding, LAPD spokeswoman.
Meanwhile, Enrique Lizarraga, 34, the brother of San Jose, said his brother was a rapper who was on his way to a recording session at a nearby studio when the shooting occurred about a half mile from his home.
Lizarraga said the driver of the car was a cousin of San Jose's friend and didn't have a license or identification.
"Basically, (the driver) got scared and he tried to flee and everybody told him to stop," said Lizarraga after talking to several of the car's occupants, who also said his brother didn't have a weapon in his hand when he exited the vehicle.
"The officer said he was scared for his partner's life," Lizarraga said. "The cops said my brother came out and tried to rush one of the officers, which wasn't true. We have witnesses who actually saw what happened."
The shooting is being probed by the department's Force Investigation Unit, which reviews all officer-involved shootings.
LAPD Lt. Ruben De La Torre urged witnesses to come forward to help investigators sort through what happened by calling 1-877-LAWFULL.
